These general terms of sale (hereinafter, "GTS") are valid for any purchase made on the French website www.bscplace.com (hereinafter, the "Site").

PREAMBLE

These General Terms and Conditions express the entirety of the parties' obligations. In this sense, it is understood that the buyer accepts them without reservation. They apply to the exclusion of all other conditions, particularly those applicable to in-store sales. If one or more clauses of the General Terms of Sale are declared invalid or deemed as such by law, regulation, or judicial decision, the other stipulations will retain their full force and scope.

PERSONAL DATA AND COOKIES

When placing an order, the collected personal data will be subject to computer processing. Please refer to the "Personal Data" tab on the Site for information related to this.

1. OBJECT AND SCOPE OF APPLICATION

   The purpose of the General Terms of Sale is to inform any person visiting the Site to place an order (hereinafter, "Buyer") about the conditions and terms under which the seller, BSCPLACE, proceeds with the sale and delivery of the ordered products. The buyer declares to have read these General Terms and Conditions and accepted them before making the purchase. BSCPLACE reserves the right to modify the General Terms and Conditions at any time without prior notice. The order is subject to the General Terms and Conditions in effect at the time of placing the order.

   Before placing the order, the Buyer declares:

   - Full legal capacity to place an order on the Site.

   - Acceptance of the General Terms and Conditions without reservation.

   - That the order is not directly related to their professional activity and is strictly for personal use.

2. FORMATION OF THE CONTRACT AND ORDERS

   **2.1 PRICE**

   Product prices on the Site are indicated in euros and are valid at the time the Buyer places the order. Prices may be modified by BSCPLACE at any time, with notice to the Buyer. Shipping costs will be indicated before the Buyer finalizes the order.

   **2.2 PRODUCT FEATURES AND AVAILABILITY**

   The buyer can review essential product features on the Site before placing an order. BSCPLACE may modify the product range on the Site based on supplier limitations. Product availability information is provided to the buyer when placing the order.

   **2.3 ORDER**

   To place an order, the Buyer must create a customer account or place the order as a "GUEST." In both cases, personal data must be provided. The Buyer guarantees the truthfulness of the information provided.

   The Buyer has the opportunity to review the proposed order details and correct any errors before final confirmation. After checking the order content in the cart, the Buyer can confirm the order by clicking the "Buy" button. The confirmation of the order will be sent to the Buyer via email.

3. PAYMENT

   **3.1 PAYMENT TERMS**

   Accepted payment methods are those approved by the Redsys payment gateway. All bank charges are the responsibility of the Buyer.

   **3.2 PAYMENT TRANSACTION SECURITY**

   BSCPLACE commits to using the most efficient encrypted and secure payment methods available. Financial transactions are carried out on the partner HIPAY's banking interface.

   **3.3 PAYMENT INCIDENTS**

   BSCPLACE reserves the right to suspend or cancel any order and/or delivery in case of non-payment, partial payment, fraud, or attempted fraud.

   **3.4 LATE PAYMENT INTEREST**

   Unpaid amounts will automatically accrue interest at the legal rate, charged to the customer's account.

4. DELIVERY

   Our delivery times are directly linked to the selected transport company to ensure efficient service. Deliveries do not take place on weekends or holidays.

   It is essential to note that some areas, mainly due to geographical location, may experience extended delivery times beyond the standard 48 hours. This variation may result from logistical factors beyond our direct control, but we strive to keep our customers informed of any possible delays.

   **4.1 SHIPPING**

   BSC PLACE is dedicated to providing an exceptional shopping experience, and part of that experience is our shipping and returns policy. We offer various shipping options, including delivery to a pickup point and home delivery.

7. LEGAL RIGHT OF WITHDRAWAL

   **7.1 EXERCISE OF THE LEGAL RIGHT OF WITHDRAWAL**

   According to the Consumer Code, the Buyer has a period of fourteen (14) natural days from the day following the receipt of the package containing the ordered products to notify BSCPLACE of their desire to exercise their right of withdrawal without providing reasons. After this period, the Buyer cannot exercise their legal right of withdrawal. In the case of multiple products subject to separate deliveries, the fourteen (14) days are counted from the day following the receipt of the last product ordered.

   The Buyer can express their desire to withdraw directly through the "Returns" tab on their customer account by completing the withdrawal form. Once completed, BSCPLACE will immediately acknowledge receipt of the withdrawal via the provided email address.

   The Buyer must follow this procedure:

   - Request the return via email at info@Bscplace.com, indicating the order number and the name of the order holder.

   **7.2 RETURN OF PRODUCTS**

   The Buyer must return the product without undue delay and, in any case, no later than fourteen (14) days from the day BSCPLACE was informed of the withdrawal decision.

   **7.3 RETURNS**

   Before proceeding with a return, it is vital to verify that the order meets the following requirements:

   - The product must not have been used.

   - It must be returned in the same condition as it was sent.

   - Returns will not be accepted if there are stains, tears, or any defects preventing resale.

   The return period is 14 natural days from the product's receipt.

   **7.4 RETURN COSTS**

   Regarding return costs:

   - The Buyer is responsible for the return shipping costs. If a customer wishes to return a product, they must do so within 14 natural days from receiving the package. The customer must send an email requesting the return to info@bscplace.com. Once the return request is made, BSC PLACE will send a return label, which must be placed on the package, ensuring it meets the return requirements. When we receive the product in good condition, we will process the refund, deducting the shipping cost.

8. LEGAL WARRANTIES

   All products supplied by BSCPLACE benefit from the legal conformity warranty and the hidden defects warranty provided by the Consumer Code and the Civil Code, respectively.

9. COMMERCIAL POLICY

   **9.1 ONLINE PURCHASE AND RETURN**

   Within fourteen (14) natural days following the receipt of the order, the Buyer may return part or all of their order. The buyer must go to the contact page, fill out the form, and explain the reason for the return.

   The Buyer must return the product in its original box, unused. Any returned product, especially incomplete, damaged, worn, dirty, or unsuitable for resale as new, cannot be refunded.

   In case of a return, BSCPLACE will refund all payments received, including shipping costs

, without delay and once the goods are received.

11. INTELLECTUAL PROPERTY

    All texts, comments, works, illustrations, and images on the Site are the exclusive property of BSCPLACE, the sole holder of the intellectual property rights. Any reproduction, in whole or in part, is strictly prohibited and may constitute a forgery offense.

12. LIABILITY

    BSCPLACE has an obligation of means for all stages of the order process and the subsequent stages of the sales contract. BSCPLACE's liability cannot be engaged if the breach of its obligations is attributable to a third party, the buyer's fault, or a force majeure event.

13. SIGNATURE AND PROOF

    The use of the Buyer's identifier and/or password, providing the credit card number, and the final validation of the order constitute proof of their identity, payment of the order, and the corresponding sums. BSCPLACE is not responsible for the fraudulent use of this information, reminding the Buyer to maintain the security of their online transactions.

14. CONTRACT FILING TERMS

    Order and invoice filing is done on a reliable and durable medium that corresponds to a faithful and lasting copy.

15. DISCLAIMER

    The fact that one of the parties does not take advantage of a breach by the other party of any of the obligations in these general conditions shall not be construed as a waiver of that obligation for the future.

16. LAW AND APPLICABLE LAW

    The General Terms of Sale are subject to French law and the mandatory rules of the Buyer's country of residence. In case of a dispute, the competent court will be the one at the domicile of the defendant or, at their choice, the place of effective delivery of the product.

    Under no circumstances does BSCPLACE offer any guarantee of compliance with the local laws applicable when accessing the Site from other countries. In case of a dispute, an amicable solution will be sought first. If not reached, the Buyer is informed of the possibility to initiate an alternative dispute resolution procedure or legal action.

    According to the Consumer Code regarding "consumer mediation process," the customer has the right to use the free mediation service unrelated to BSCPLACE.
